About these terms
These terms apply when you use xmmedialaunch.cheap or hire XM Media ("we", "us") to design, build or maintain a website or other online service for you ("you", "the client"). By using our site or accepting a quote, you agree to these terms.
Quotes and scope
Before we start, we send you a written quote describing what we will build, the price and the expected timeline. Work outside that quote, such as extra pages or features, is quoted separately before we do it.
Free homepage mockups are offered without obligation. Until you accept a quote and pay any required deposit, you have no obligation to us and we have no obligation to build the project.
Payment
Prices, deposits and due dates are set out in your quote or invoice. Unless your quote says otherwise, payments are due before the site goes live.
Monthly plans (such as hosting and care) are billed in advance. You can request changes to your plan in the client portal; our team confirms and processes payment changes manually.
If a payment is overdue, we may pause work or hosting until it is paid.
Timelines
Our typical timeline is 7 to 14 days from when we receive everything we need from you (content, photos, logins and approvals). Delays in receiving these will move the launch date.
Your responsibilities
You confirm that you own or have permission to use all content you give us, such as text, photos, logos and trademarks, and that it does not break any law.
You are responsible for the accuracy of your business information, prices and claims shown on your site.
Revisions and approval
Each quote includes a set number of revision rounds. When you approve a design or the finished site, further changes may be charged as new work.
Ownership
Once you have paid in full, you own your website's design and the content made for you, and we will hand over access to it. We keep the right to reuse our general know-how, code libraries and tools, and to show your project in our portfolio unless you ask us not to.
Third-party software, fonts, images and plugins remain subject to their own licences.
Hosting, domains and third-party services
Where we set up hosting, domains, email, payment providers or other third-party services for you, those services are provided by their owners under their own terms. We are not responsible for their outages, price changes or policies.
Domains registered for you are registered in your name or transferred to you on request.
Use of AI
Our developers use AI tools to work faster. A person reviews every page, and nothing goes live until you approve it. Our website chat assistant is automated and may make mistakes; a member of our team confirms all quotes and commitments.
Cancellation
You can cancel a project in writing at any time. You pay for work completed up to that point; any deposit covers work already started and is non-refundable unless your quote says otherwise.
You can cancel a monthly plan at any time; it stops at the end of the period already paid for.
Warranties and liability
We build every project with care and fix defects in our work that you report within 30 days of launch at no charge. Apart from that, our services are provided "as is", and we do not guarantee specific results such as search rankings, traffic or sales.
To the extent the law allows, our total liability for any claim relating to a project is limited to the amount you paid us for that project, and we are not liable for indirect losses such as lost profits or lost data.
Acceptable use
We will not build or host sites for illegal activity, scams, hateful content or content that infringes others' rights. We may stop work or hosting if a site breaks this rule.
Changes and governing law
We may update these terms from time to time; the date at the top shows when they last changed. Projects already underway keep the terms in effect when you accepted the quote.
These terms are governed by the laws of [STATE OR COUNTRY], without regard to conflict-of-law rules.
